1. Purpose & Scope
This SMS & Messaging Policy governs all text (SMS/MMS) and automated voice messages sent through any Trademate service or AI agent, now or in the future. Trademate is an AI services platform incorporated in California.
Our platform is used by subscribing businesses to automate customer communications — including inquiry response, scheduling, follow-up, and review management. This Policy applies to all such communications facilitated through Trademate infrastructure.
We operate in full compliance with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, CTIA Messaging Principles and Best Practices, and our telecommunications infrastructure provider's (Twilio) Acceptable Use Policy.
2. Who Sends These Messages
Messages sent through Trademate are delivered on behalf of the subscribing business using our AI technology. The sender identity displayed to the end recipient is the subscribing business — not Trademate directly.
Trademate functions as the technology service provider. The subscribing business is responsible for ensuring their use of Trademate communication tools complies with applicable federal and state law.
3. Types of Messages
Transactional Messages — sent based on implied or express consent:
- Immediate responses to inbound customer inquiries across any channel
- Appointment confirmations, reminders, and rescheduling notices
- Service delivery updates (job status, arrival estimates, completion notices)
- Post-service follow-up and review requests
- Account or service notifications to Trademate subscribers
Promotional / Marketing Messages — require prior express written consent:
- Service renewal or upsell offers to existing customers
- Seasonal promotions or campaigns configured by the subscribing business
- Re-engagement messages to contacts who have not interacted recently
4. How Users Opt In — Message Flow & Call to Action
End users consent through the following opt-in methods. Both methods are documented below to satisfy A2P 10DLC campaign registration (TCR) requirements.
When a customer calls a Trademate-enabled business number and the call is missed, the business voicemail greeting informs the caller:
The customer initiates the text conversation by texting first. Trademate only responds after the customer sends the first message. The automated first reply is:

Consent documentation: All opt-in records — inbound SMS logs and keyword opt-in confirmations — are retained for a minimum of 4 years in compliance with TCPA requirements.

6. How to Opt Out (STOP)

To stop receiving messages at any time, reply with any of the following keywords:

Opt-outs are processed immediately and automatically. No further messages will be sent after a STOP request, except a single confirmation message.
Opted-out numbers are added to a suppression list and will not be contacted again unless the individual explicitly re-consents by texting JOIN.

7. Message Frequency
Message frequency varies based on customer activity, the nature of the service, and the subscribing business's configuration. For a typical transactional service cycle, recipients may receive 4–8 messages (initial response through post-service follow-up). Promotional messages are subject to frequency limits set by the subscribing business.
Trademate does not send bulk unsolicited messages. All campaigns must be configured by the subscribing business and must comply with applicable carrier and CTIA requirements.
8. Costs & Carrier Disclosure
Trademate does not charge end recipients for messages. However:
- Standard message and data rates may apply depending on the recipient's mobile carrier plan
- Trademate is not responsible for carrier-level filtering, delivery failures, or charges imposed by the recipient's carrier
- SMS delivery is not guaranteed across all networks or geographic areas
9. Data Use in Messaging
- Phone numbers are collected only from inbound contacts or from lists uploaded by subscribing businesses with documented consent
- Phone numbers and message content are used exclusively to facilitate the communication services described in this Policy
- No mobile information (including phone numbers, SMS opt-in data, or message content) will be shared with third parties or affiliates for marketing or promotional purposes. This data is never sold, rented, or transferred for any commercial purpose
- Message metadata (timestamps, delivery status) is retained for up to 90 days for operational and compliance purposes
- Opt-in consent records are retained for a minimum of 4 years per TCPA requirements

10. Prohibited Messaging
The following are strictly prohibited through any Trademate service:
- Messages to any recipient who has previously opted out
- Unsolicited commercial messages to individuals with no prior business relationship or documented consent
- Phishing, fraudulent, misleading, or deceptive messages of any kind
- Messages containing illegal content or facilitating illegal transactions
- Messages impersonating government agencies, financial institutions, or any other organization
- High-volume promotional blasts without prior express written consent
- Any messaging that violates applicable federal, state, or local law
Violations will result in immediate account suspension and may be reported to applicable carriers and regulatory authorities.

This Policy is reviewed quarterly and updated as applicable regulations and industry standards evolve.
